Family members of U.S. Citizens

There are various visa categories that apply to the U.S. citizen’s family member:

  • Immediate Relatives:  Spouses, parents, and children (under 21) of U.S. citizen
  • FB-1 First Preference:  Unmarried sons and daughters of U.S. citizen
  • FB-3 Third Preference:  Married sons and daughters of U.S. citizen
  • FB-4 Fourth Preference:  Brothers and sisters of U.S. citizen
  • K-1 Fiancé(e) Visa:  Nonimmigrant visas for fiancé(e)s of U.S. citizen
  • K-3 Visa:  Foreign citizen spouse of U.S. citizen whose immigrant visa petition for permanent residency has not been approved and allows the spouse to enter the United States to await approval of the visa petition.

Family members of Legal Permanent Residents

Legal Permanent Residents are able to petition for family members under certain visa categories.  The number of visas available in these categories is limited each fiscal year:

  • FB-2A Second Preference:  Spouses and unmarried children of permanent residents
  • FB-2B Second Preference:  Adult sons and daughters of permanent residents.
  • V Visas:  Spouses or children (unmarried and under the age of 21) of lawful permanent residents whose I-130 Immediate Relative Petition was filed before December 21, 2000, and the petition is still pending after three years.
